Effective Date: October 15, 2026
These Terms and Conditions (the “Terms”) govern your use of https://www.printsonthefly.com and every order you place with Prints on the Fly for custom printed and embroidered products. Please read them carefully. By using the Site or placing an Order you agree to them.
1. ABOUT THESE TERMS
1.1 Who We Are. The Site is operated by Custom DTF Printing, trading as Prints on the Fly (“Prints on the Fly”, “we”, “us” or “our”), of Custom DTF Printing. You can contact us at customerservice@printsonthefly.com.
1.2 Agreement. These Terms, together with our Privacy Policy, Cookie Policy, Returns, Cancellations and Refund Policy and Copyright and Intellectual Property Policy, form the agreement between you and us. Each of those documents is available at https://www.printsonthefly.com.
1.3 Acceptance. You accept these Terms by browsing the Site, creating an account, uploading Customer Content or placing an Order. If you do not agree, do not use the Site.
1.4 Changes. We may update these Terms from time to time by posting the updated version on the Site with a new Effective Date. An update applies to your use of the Site after it is posted. An Order you have already placed stays subject to the Terms in force when you placed it.
2. DEFINITIONS
2.1 Defined Terms. In these Terms:
“Customer Content” means any artwork, logo, image, photograph, text, name, slogan, design or other material that you upload, type, select or otherwise submit to us for use on a Product;
“Custom Product” means any Product that is printed, embroidered, personalized or otherwise altered to your specifications, including by the addition of Customer Content or Design Library Content;
“Design Library Content” means the images, graphics, templates and design elements that we make available on the Site for you to select;
“Order” means a request to buy Products that you submit through the Site or by any other method we accept;
“Product” means any apparel, promotional item or other goods offered by us, whether or not customized;
“Site” means https://www.printsonthefly.com and any design tool, page or service available through it; and
“Standard Product” means a Product that is not a Custom Product and that you have not altered in any way.
3. ELIGIBILITY AND ACCOUNTS
3.1 Eligibility. You must be at least 18 years old and able to enter into a binding contract to place an Order. If you are younger than 18, a parent or legal guardian must place the Order and accepts these Terms on your behalf.
3.2 United States Only. We sell and ship only within the United States, including Alaska and Hawaii. By placing an Order you confirm that the delivery address is in the United States.
3.3 Accounts. If we offer accounts, you must give accurate and current information and keep your login details confidential. You are responsible for activity under your account. Tell us promptly if you suspect unauthorized use.
3.4 Accurate Information. You are responsible for the accuracy of the name, email address, billing address and delivery address you give us.
4. PRODUCTS AND SERVICES
4.1 What We Offer. We offer promotional and personalized products that can be customized with logos, fundraising designs, family reunion and event designs, celebrations and personal messages. We decorate Products using direct to film (DTF) printing and embroidery.
4.2 Descriptions. We try to describe and display Products accurately. Colors on a screen may differ from the finished item because of screen settings, fabric, ink and thread. Sizes, garment brands and styles may be substituted with an equivalent where the original is unavailable, as Section 16 explains.
4.3 Availability. Products and prices are subject to availability. We may discontinue a Product or change its price at any time before we accept your Order.
5. CUSTOM ORDERS, ARTWORK AND PROOFS
5.1 Your Specifications. For a Custom Product, you choose the Product, design, placement, size, colors, quantities and wording. We produce the Product to the specifications you submit and approve.
5.2 Proofs and Previews. Where the Site or we show you a preview, mockup or proof, it is an illustration of the intended result. Once you approve it, or once you submit the Order without requesting a change, you accept the design, spelling, grammar, placement, sizing and colors shown. We are not responsible for errors in content that you supplied or approved.
5.3 Artwork Quality. The quality of a print or embroidery depends on the quality of the artwork. Low resolution files, fine detail, small text and gradients may not reproduce well, particularly in embroidery. We may adjust, resize, vectorize or simplify artwork where needed to produce it, and we may decline an Order we cannot produce to an acceptable standard.
5.4 Right to Refuse. We may refuse, pause or cancel any Order, and refund the amount paid for it, if the Customer Content is or appears to be unlawful, infringing, offensive, or otherwise unsuitable under Section 9 or the Copyright and Intellectual Property Policy, or if we cannot produce it as requested.
6. CUSTOMER CONTENT AND COPYRIGHT RESPONSIBILITY
6.1 Your Ownership and Our Licence. You keep whatever rights you have in your Customer Content. You grant us a non-exclusive, worldwide, royalty-free licence to reproduce, adapt for production purposes, store and display your Customer Content as needed to review, produce, fulfil, support and document your Order and to operate the Site.
6.2 Your Promises. By submitting Customer Content you promise that: (a) you own it or you hold every licence, consent and permission needed to use it and to have us reproduce it on the Products; (b) it does not infringe or violate any copyright, trademark, right of publicity or privacy, or other right of any person; and (c) it is not unlawful or prohibited by Section 9.
6.3 No Duty to Check. We do not review Customer Content for ownership, originality or legality, and we have no obligation to do so. Our production of an Order is not a statement that Customer Content is lawful or that you have the right to use it.
6.4 Your Responsibility. As between you and us, you are solely responsible for Customer Content and for any claim, demand, loss or liability that arises from it, including any claim that it infringes the rights of a third party. Section 21 applies.
6.5 Our Rights. Despite Section 6.3, we may remove Customer Content, refuse to produce it and cancel the affected Order if we receive a complaint about it or have reason to believe it infringes the rights of another person or breaches these Terms. Where we do so because of an infringement complaint, our Copyright and Intellectual Property Policy applies.
6.6 Notes About Licensed Brands. Logos, characters, sports team marks, entertainment properties and other branded designs are normally owned by others. Do not submit them unless you hold written permission from the owner.
7. DESIGN LIBRARY CONTENT
7.1 Licence to You. If you select Design Library Content for an Order, we grant you a limited, non-exclusive, non-transferable, revocable licence to have it reproduced on the Products in that Order for your own personal, family, event, fundraising or internal business use.
7.2 Restrictions. You may not copy, resell, sublicense, register as a trademark, or use Design Library Content for any other purpose, on any other goods, or as a stand-alone file, unless we agree in writing. We may make the same Design Library Content available to other customers.
7.3 Changes. We may add, change or remove Design Library Content at any time.
8. OUR INTELLECTUAL PROPERTY
8.1 Ownership. The Site, its software, layout, text, graphics, Design Library Content, the name “Prints on the Fly” and all related logos and marks are owned by or licensed to us and are protected by law. Except for the limited rights in Section 7, nothing in these Terms transfers any right in them to you.
8.2 Use of the Site. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for its intended purpose of browsing and ordering Products.
8.3 Feedback. If you give us suggestions or feedback about the Site or our services, we may use them without restriction or payment to you.
8.4 Display of Work. Unless you ask us in writing before production, we may photograph finished Products and display the photographs to show our work. We will not display a name or contact details of yours with them without your permission.
9. ACCEPTABLE USE AND SUSPENSION
9.1 Prohibited Conduct. You must not: (a) submit Customer Content that is unlawful, defamatory, obscene, threatening, hateful or harassing, that promotes violence or discrimination, or that infringes any person’s rights; (b) use the Site to commit fraud, including by using a payment method you are not authorized to use; (c) interfere with the Site, probe its security, scrape it or use automated tools to access it without our permission; (d) misrepresent your identity; or (e) use the Site in a way that breaches any law.
9.2 Counterfeit and Restricted Goods. You must not use us to produce counterfeit goods, goods that imitate government, police or emergency identification, or anything that falsely suggests endorsement by another person or organization.
9.3 Suspension and Termination. We may suspend or close your account, refuse Orders and block access to the Site if we reasonably believe you have breached these Terms, applicable law or the rights of others, or if we need to do so to protect the Site or other customers. Sections that by their nature should continue to apply after termination will do so.
10. PRICING, TAXES AND ORDER ACCEPTANCE
10.1 Prices. Prices are shown in United States dollars. The price of a Custom Product may depend on the Product, quantity, print or embroidery method, size, placement, colors and artwork. We may correct an obvious pricing or typographical error before we accept an Order.
10.2 Taxes. We charge sales tax and similar taxes where we are required to by law. The amount is calculated from the delivery address and shown before you pay or, where it cannot be shown earlier, as soon as it can be calculated.
10.3 Shipping Charges. Shipping charges, and any free shipping offer, are shown at checkout before you pay. A free shipping offer applies only on the conditions stated with it.
10.4 Order Acceptance. Your Order is an offer to buy. A confirmation email acknowledging your Order does not by itself accept it. We accept your Order when we begin production of it or ship it, whichever is first. We may decline an Order for any lawful reason, including a pricing error, suspected fraud, inventory limits or the reasons in Section 5.4, and if we do so after payment we will refund you.
11. PAYMENT
11.1 Accepted Methods. We accept Visa, Mastercard and debit cards and, where the Site offers it, PayPal. We may change the accepted methods at any time.
11.2 Authorization. By submitting payment you confirm that you are authorized to use the payment method and authorize us and our payment service providers to charge it for the total of your Order, including products, shipping and taxes.
11.3 Timing. Payment is due in full when you place an Order. We may delay production until payment is received and cleared.
11.4 Payment Processors. Payments are processed by third party payment service providers. Their terms and privacy policies apply to the processing, and we are not responsible for their acts or omissions. Our Privacy Policy explains how payment information is handled.
11.5 Declined or Reversed Payments. If a payment is declined, fails or is reversed, we may cancel or hold the Order. You remain responsible for the amount due, and we may recover it, together with any fees a processor charges us because of the reversal, to the extent the law allows.
11.6 Suspected Fraud. We may take steps to verify your identity, payment method and delivery address, and we may hold or cancel an Order that fails verification.
12. PAYPAL AND PAYMENT DISPUTES
12.1 Contact Us First. If you have a problem with an Order, you agree to contact us first at orders@printsonthefly.com, and give us a reasonable opportunity, not less than 10 days, to resolve it before you start a dispute, claim, chargeback or reversal with PayPal, your card issuer or your bank. Most problems can be resolved faster directly.
12.2 Records You Accept. You agree that our Order records, including your Order confirmation, approved proofs or previews, the Customer Content you submitted, delivery confirmation and your communications with us, are accurate evidence of what you ordered, approved and received unless you show otherwise. We may give those records, and any other relevant information, to PayPal, a card network, an issuer or a bank to respond to a dispute.
12.3 Custom Products. You acknowledge that a Custom Product is made specially for you, is not a Standard Product, and is non-refundable except as our Returns, Cancellations and Refund Policy provides. A dispute that seeks a refund of a Custom Product that was produced as ordered and approved is, to the extent the law allows, contrary to these Terms.
12.4 Limits of This Section. PayPal, card networks and issuers operate under their own rules, and their decisions are not controlled by these Terms. This Section does not limit any right you have under the rules of those providers or under the Fair Credit Billing Act or other law that cannot be waived. Nothing in it prevents you from disputing an unauthorized or fraudulent charge.
12.5 Duplicate Recovery. If you receive a refund or credit through a dispute, you may not also keep a refund or replacement from us for the same Order. If you do, you must repay us the duplicate amount.
13. PRODUCTION AND SHIPPING
13.1 Production Time. Production time depends on the Product, quantity, decoration method, artwork approval and our workload. Production and delivery estimates are not guaranteed, and time is not of the essence unless we have agreed a delivery date in writing.
13.2 Rush Orders. If we offer rush production, any extra charge and the target dates will be stated before you pay.
13.3 Where We Ship. We ship only to addresses in the United States, including Alaska and Hawaii. We do not ship outside the United States and we do not ship to international freight forwarders.
13.4 Carriers and Delivery. We ship using carriers we select. Delivery estimates are provided by the carrier and may change. Delays caused by carriers, weather, or other events outside our control are not our responsibility.
13.5 Risk of Loss. Risk of loss and damage passes to you when we deliver the Products to the carrier for delivery to you, except where the law provides otherwise. If a package is lost or damaged in transit, tell us within the time stated in our Returns, Cancellations and Refund Policy and we will work with you and the carrier to resolve it.
13.6 Wrong or Undeliverable Address. You are responsible for the delivery address you provide. If a package is returned to us because the address was wrong or incomplete or because delivery was refused or unclaimed, we may charge you the cost of re-shipping it.
13.7 Partial Shipments. We may ship an Order in more than one shipment. Each shipment may be delivered separately and on different days.
14. CANCELLATIONS AND CHANGES
14.1 Before Production. You may ask us to cancel or change an Order before we have begun production of it by contacting us as soon as possible at orders@printsonthefly.com. If we have not begun production, we will cancel or change it and refund any amount paid for the cancelled part.
14.2 After Production Starts. Once we have begun production of a Custom Product, the Order cannot be cancelled or changed, and the amount paid is not refundable except as our Returns, Cancellations and Refund Policy provides. We will tell you if production has already begun.
14.3 Our Cancellation. We may cancel an Order as Sections 5.4 and 10.4 permit. We will refund amounts paid for any Order that we cancel before shipment.
15. RETURNS AND REFUNDS
15.1 Custom Products. A Custom Product is made to your specifications and cannot be returned or refunded because you changed your mind, ordered the wrong size, color or quantity, or are unhappy with a design you approved or supplied.
15.2 Standard Products. A Standard Product may be returned for a refund if you meet the conditions and time limits in our Returns, Cancellations and Refund Policy.
15.3 Our Errors and Defects. If we deliver a Product that is defective, damaged or different from the Order you approved, our Returns, Cancellations and Refund Policy provides a remedy. That remedy applies even to a Custom Product.
15.4 Policy Governs. The Returns, Cancellations and Refund Policy is part of these Terms. If it differs from a summary in these Terms, the Returns, Cancellations and Refund Policy governs.
16. PRODUCT VARIATION, QUALITY AND CARE
16.1 Natural Variation. Because Products are decorated by hand and machine, minor variations in print position, color shade, stitch density, size and finish are normal and are not defects. Each garment batch may also vary slightly from another.
16.2 Substitution. If a garment, style or color is unavailable, we may substitute a comparable item. If a substitution would materially change the appearance of your Order, we will contact you before production.
16.3 Care. Follow the care instructions provided with the Product. We are not responsible for damage to a print or embroidery caused by washing, drying, ironing, bleaching, dry cleaning or other care that does not follow those instructions.
16.4 Use of Products. You are responsible for deciding whether a Product is suitable for your intended use, including any safety, flammability, sizing or children’s product requirement. We do not make any representation that a Product is suitable for a particular purpose.
17. FUNDRAISING, GROUP AND EVENT ORDERS
17.1 Your Role. If you order for a school, club, team, family, charity, business or event, you are the customer. You are responsible for collecting any money from the people you represent, for the quantities and sizes ordered, and for confirming the design with the group before you approve it.
17.2 Fundraising Statements. We do not run fundraisers, collect funds for charitable purposes or make any statement about how funds raised are used. Any statement on your design about a charity or cause is your Customer Content and your responsibility.
17.3 Deadlines. If you need the Products by a particular date, tell us before you order. We will confirm in writing whether we can meet it. Without that confirmation Section 13.1 applies.
17.4 Final Quantities. Orders for groups are produced at the quantities and sizes submitted. Late additions or changes are a new Order and are subject to Section 14.
18. THIRD PARTY SERVICES AND LINKS
18.1 Third Party Services. The Site relies on third party services such as hosting, payment processing and shipping. We are not responsible for the content, policies or conduct of third parties.
18.2 External Links. The Site may contain links to websites we do not operate. A link is not an endorsement. We do not control those websites and you use them at your own risk.
19. DISCLAIMER OF WARRANTIES
19.1 As Is. To the fullest extent the law allows, the Site is provided “as is” and “as available”. We do not promise that the Site will be uninterrupted, secure or free from errors or harmful components.
19.2 Products. We warrant only that we will produce a Custom Product substantially in line with the Order as you approved it and that a Product will be free from defects in our workmanship as stated in the Returns, Cancellations and Refund Policy. Except for that and any warranty that cannot be excluded by law, we disclaim all other warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
19.3 Your Statutory Rights. Some states do not allow certain warranty exclusions, so part of this Section may not apply to you. You may have other rights that vary by state.
20. LIMITATION OF LIABILITY
20.1 Exclusion. To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data or business opportunity, arising out of or relating to the Site or any Order, even if we were told they were possible.
20.2 Cap. To the fullest extent the law allows, our total liability to you for any claim arising out of or relating to the Site or an Order is limited to the amount you paid us for the Order that the claim concerns.
20.3 Event Items. We are not liable for loss arising because Products did not arrive by a date for an event, unless we agreed that date in writing under Section 17.3.
20.4 Exceptions. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by our negligence where the law does not allow that limit.
21. INDEMNIFICATION
21.1 Your Indemnity. You agree to defend, indemnify and hold harmless Prints on the Fly and its owners, officers, employees, contractors and agents from and against any claim, demand, loss, liability, damage, cost and expense, including reasonable attorneys’ fees, arising out of or relating to: (a) your Customer Content, including any claim that it or its reproduction on a Product infringes or violates the copyright, trademark, publicity, privacy or other right of any person; (b) your breach of these Terms; (c) your breach of any law; or (d) your use of a Product in a way we did not authorize.
21.2 Procedure. We will tell you promptly of a claim that you are required to indemnify, and you will cooperate. We may take part in the defense with our own counsel at our own cost. You may not settle a claim in a way that admits fault by us or restricts us without our written consent.
22. FORCE MAJEURE
22.1 Events Beyond Control. We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disaster, fire, flood, severe weather, epidemic, war, terrorism, civil disturbance, labor dispute, government action, utility or internet failure, supplier or carrier failure and shortages of blank garments or materials.
22.2 Effect. The time for performance is extended for the length of the event. If the event continues for an unreasonable time, either of us may cancel the affected part of the Order and we will refund any amount paid for the part that has not been produced or shipped.
23. GOVERNING LAW AND VENUE
23.1 Governing Law. These Terms and any dispute arising out of them or the Site are governed by the laws of the State of Maryland and applicable federal law of the United States, without regard to conflict of law rules. Section 24 is governed by the Federal Arbitration Act.
23.2 Venue. Subject to Section 24, you and we agree that any court action permitted by these Terms will be brought only in the state or federal courts located in Maryland, and each of us consents to the jurisdiction of those courts. This does not limit any mandatory consumer protection law that gives you the right to sue in the courts of your home state.
24. DISPUTE RESOLUTION
24.1 Informal Resolution First. Before starting any formal proceeding, you and we agree to try to resolve the dispute informally. The party raising it must send a written notice describing it. Both parties will then negotiate in good faith for 30 days. Notices to us go to customerservice@printsonthefly.com.
24.2 Binding Individual Arbitration. If a dispute is not resolved within that time, you and we agree to resolve it by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court, except as Section 24.4 provides. The arbitrator may award the same individual relief a court could. A hearing, if one is needed, will be held by video or telephone or in the county where you live, as the rules provide.
24.3 No Class Actions. To the fullest extent the law allows, each of us may bring claims only in an individual capacity and not as a plaintiff or class member in a class, collective or representative proceeding. The arbitrator may not combine claims of more than one person. If this Section 24.3 is found unenforceable for a claim, that claim will proceed in court under Section 23.2 and not in arbitration.
24.4 Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may seek an injunction in court to stop infringement or misuse of intellectual property.
24.5 Opt Out. You may opt out of Section 24.2 and 24.3 by sending us written notice at optout@printsonthefly.com within 30 days of first accepting these Terms. The notice must include your name, address and a clear statement that you opt out of arbitration.
24.6 Time Limit. To the extent the law allows, any claim arising out of the Site or an Order must be started within one year after it arose, or it is permanently barred.
25. GENERAL AND CONTACT
25.1 Entire Agreement. These Terms and the documents referred to in Section 1.2 are the entire agreement between you and us about the Site and your Orders and replace all earlier understandings on that subject.
25.2 Severability. If a provision is held invalid or unenforceable, it will be applied to the extent allowed and the rest of these Terms will remain in effect.
25.3 No Waiver. A failure or delay in enforcing a right is not a waiver of it.
25.4 Assignment. You may not assign these Terms without our written consent. We may assign them, including to a buyer of our business.
25.5 Electronic Communications. You agree that we may communicate with you electronically, including by email and by posting notices on the Site, and that those communications satisfy any legal requirement that they be in writing.
25.6 Privacy. Our handling of personal information is described in our Privacy Policy, and our use of cookies in our Cookie Policy.
25.7 Contact. Prints on the Fly (Custom DTF Printing), Customer Service. Email: customerservice@printsonthefly.com. Website: https://www.printsonthefly.com.
