COPYRIGHT AND INTELLECTUAL PROPERTY POLICY
Prints on the Fly
https://www.printsonthefly.com
Effective Date: October 15, 2026
This Copyright and Intellectual Property Policy explains how Prints on the Fly treats copyright and other intellectual property in artwork that customers upload or select, and how to notify us of a claim of infringement. It forms part of our Terms and Conditions. Terms defined there, such as “Customer Content”, “Design Library Content”, “Order” and “Product”, have the same meaning here.
1. OUR COMMITMENT
1.1 Respect for Rights. We respect the intellectual property rights of others and expect our customers to do the same. We will respond to notices of alleged infringement that comply with the law.
1.2 Scope. This Policy covers copyright, trademark, right of publicity and similar rights in Customer Content and in anything else on the Site or printed on a Product.
2. CUSTOMER RESPONSIBILITY FOR CUSTOMER CONTENT
2.1 Your Warranty. When you submit Customer Content you confirm that you own it or hold every licence, consent and permission needed to use it and to have us reproduce it on Products, and that it does not infringe the rights of any person.
2.2 No Duty to Verify. We do not review Customer Content for ownership or lawfulness and we are not required to check it. Producing an Order is not a statement that the Customer Content is lawful or that you may use it.
2.3 Your Responsibility. As between you and us, you are solely responsible for Customer Content, including any claim that it infringes the rights of a third party. Section 21 of the Terms and Conditions applies.
3. MATERIAL THAT YOU MUST NOT SUBMIT
3.1 Examples. Unless you hold written permission from the owner, do not submit: (a) logos, brand names, slogans and trade dress of companies and organizations; (b) characters, artwork, film, television, music, game or publishing properties; (c) sports team, league, college and school marks; (d) photographs and images copied from websites, social media, stock libraries or other sources whose licence does not allow printing on goods; (e) another person’s name, likeness or voice for use on a Product without their consent; and (f) counterfeit or imitation goods.
3.2 Free to Access Is Not Free to Use. An image that is available online is not necessarily free to copy or print. If you are unsure, ask the owner or use your own original artwork.
3.3 Our Right to Decline. We may decline or cancel an Order, in whole or in part, that appears to contain infringing material, and we will refund any amount paid for the part we do not produce.
4. DESIGN LIBRARY CONTENT
4.1 Ownership. Design Library Content is owned by us or used under licence. You may use it only as the Terms and Conditions allow, which is on the Products in your Order.
4.2 No Other Use. You may not reproduce, resell or register Design Library Content or use it as a trademark.
5. NOTICE OF CLAIMED INFRINGEMENT
5.1 Who May Send One. If you are a copyright owner, or are authorized to act for one, and you believe that material on the Site or Customer Content that we have printed or are about to print infringes your copyright, you may send us a notice under the Digital Millennium Copyright Act, 17 U.S.C. Section 512.
5.2 What the Notice Must Contain. A notice must be in writing and include: (a) your physical or electronic signature; (b) identification of the copyrighted work you claim has been infringed; (c) identification of the material you claim is infringing and enough information for us to locate it, such as the Order number, the page address or a description; (d) your name, address, telephone number and email address; (e) a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorized to act for the owner.
5.3 Where to Send It. Send the notice to our designated agent:
Name: A. Louis
Address: 3261 Old Washington Rd,
Suite 2020
Waldorf, MD 20602
Email: info@printsonthefly.com
5.4 False Claims. Under 17 U.S.C. Section 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Please consider this before sending a notice. You may wish to seek legal advice.
6. WHAT WE DO ON RECEIVING A NOTICE
6.1 Action. If a notice meets the requirements in Section 5.2, we will act promptly. We may remove or disable access to the material, stop production of the affected Order or cancel it, and refund any amount paid for the part not produced. We will use reasonable efforts to tell the customer who submitted the material.
6.2 Goods Already Produced or Shipped. If a Product has already been produced, we may decline to ship it. We will not be liable to the customer for doing so.
6.3 Information. We may give the person who sent the notice the contact details of the customer and a copy of the Customer Content, where this is needed to deal with the claim, or where the law or a court requires.
7. COUNTER NOTICE
7.1 Right to Respond. If you believe that your Customer Content was removed or an Order was stopped because of a mistake or misidentification, you may send a counter notice to our designated agent in Section 5.3.
7.2 What It Must Contain. A counter notice must be in writing and include: (a) your physical or electronic signature; (b) identification of the material and where it appeared before it was removed or disabled; (c) a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled by mistake or misidentification; and (d) your name, address and telephone number, a statement that you consent to the jurisdiction of the federal court for the district in which your address is located, or, if your address is outside the United States, any district in which we can be found, and a statement that you will accept service of process from the person who sent the original notice.
7.3 Our Response. On receiving a valid counter notice, we will send a copy to the person who sent the original notice and tell them that we may restore the material, or allow the Order to proceed, in not less than 10 and not more than 14 business days unless they notify us that they have filed a court action against you. We are not obliged to restore or produce material while a claim is pending.
8. REPEAT INFRINGERS
8.1 Policy. In appropriate circumstances, we will close the account of, and refuse future Orders from, a customer who repeatedly submits infringing material.
9. TRADEMARKS AND OTHER RIGHTS
9.1 Our Marks. “Prints on the Fly” and our logos are our marks. You may not use them in a way that suggests we endorse you or your goods without our written permission.
9.2 Other Rights. If you believe Customer Content infringes your trademark, violates your right of publicity or privacy, or infringes another right, contact us at the details in Section 5.3. Include your name and contact details, the right you claim, the Order or page involved and why you believe the use is unauthorized. We will consider it and may act as Section 6.1 describes. We may ask for more information, and we are not required to act on a claim that is incomplete.
10. OUR RIGHT TO ACT
10.1 Discretion. We may remove material and refuse or cancel Orders at our reasonable discretion to protect rights, whether or not we receive a formal notice.
10.2 No Admission. Our action on a notice is not an admission that any material infringes.
11. CHANGES AND CONTACT
11.1 Changes. We may update this Policy by posting the updated version on the Site with a new Effective Date.
